Welcome to DhunAI ("Platform"), operated by DhunAI ("we," "our," or "Platform"). By accessing our website, creating an account, or synthesizing music with our neural models, you acknowledge and agree to be bound by these Terms of Service.

1. Eligibility and User Accounts

You must be at least 13 years of age (or 18 years in jurisdictions where required for contractual obligations) to use DhunAI. You are responsible for preserving the confidentiality of your login credentials and for all activities carried out under your account.

2. Ownership of Generated Music & Intellectual Property

A. Your Prompts and Lyrics

You retain full intellectual property ownership of the original text, lyrical poetry, and creative concepts you compose and submit to the platform.

B. Synthesized Audio & Commercial Ownership

• Free Tier: Audio tracks synthesized on the Free Tier are provided under a personal, non-commercial license with mandatory attribution to DhunAI. You may share them on personal social media channels for non-monetized purposes.
• Paid Tiers (Creator & Pro Studio): As between you and DhunAI, you receive full commercial exploitation rights to all audio files, stems, and MIDI exports generated during your active subscription period. You may monetize them on YouTube, Spotify, Apple Music, wedding films, commercials, podcasts, and OTT productions.
• Platform Technology: The underlying neural algorithms, latent weights, proprietary datasets, UI designs, and DhunAI trademarks remain the exclusive property of DhunAI Technologies Pvt. Ltd.

3. Prohibited Content & Safety Guidelines

DhunAI is dedicated to elevating and celebrating Indian music. We maintain a zero-tolerance policy for abuse. You agree NOT to generate or attempt to generate:

• Cloned voices or unauthorized vocal likenesses of living or deceased real-world vocalists, playback singers, politicians, or public figures without verified written legal consent.
• Audio containing communal hate speech, religious desecration, defamation, harassment, or incitement to violence under Indian Penal Code / Bharatiya Nyaya Sanhita (BNS) provisions.
• Sexually explicit, pornographic, or non-consensual content.
• Automated reverse-engineering, model extraction attacks, or unauthorized scraping of our audio inference endpoints.

4. Subscription Billing, Cancellation, and Refunds

Subscriptions are billed on a recurring monthly or annual basis via UPI, NetBanking, Credit/Debit cards, or international payment rails. You may cancel renewal at any time directly through your account dashboard. Because neural synthesis consumes real-time GPU compute power, fees paid are non-refundable once generation tokens have been used, except where mandated by statutory consumer rights.

5. Limitation of Liability & Disclaimers

DhunAI provides its generative music models on an "as is" and "as available" basis. While we maintain 99.9% uptime and state-of-the-art audio quality, we do not warrant that output tracks will be identical across distinct generation runs or completely free of minor acoustic artifacts. In no event shall DhunAI's aggregate liability exceed the subscription amount paid by you in the 3 months preceding the claim.

6. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes or arbitration arising out of your use of DhunAI shall be subject to the exclusive jurisdiction of the competent courts of Bengaluru, Karnataka, India.
